Criminal courts have the power of unlimited fines for health & safety offences but follow guidelines. Those guidelines are about to change. New guidelines from the Sentencing Council starting on 1st February 2016 will mean fines imposed for health & safety offences will rise.
The fines imposed will be based on a range of factors which include business turnover and the degree of harm. The guidelines intend for fines to be deliberately punitive and to remove any economic gain that may be derived from poor health and safety.
The Courts will have to determine the offence by category by looking at various factors. Then the turnover of the business is considered to determine a starting point for the appropriate level of fine.
The next stage involves considering of whether the fine suggested by the previous steps is “proportionate to the means of the offender”. The court might take into account things like the profitability of the business before tax, directors’ / owners’ remuneration and the assets of the business to do this.
The fourth step considers of any other factors that may warrant an adjustment of the proposed fine.
The court should adjust the fine in light of any aggravating and mitigating factors, which are likely to relate to the wider circumstances of the offence and also include factors relating to the offender. Examples of aggravating factors include cost cutting at the expense of safety and a poor health and safety record. Mitigating factors could include no of previous convictions and having effective health and safety procedures in place.
Conviction rates for individuals who turn a blind eye to unsafe practice or sacrifice health & safety for profit are also set to rise. Unless the risk of harm is very low, courts will be directed that all cases of a deliberate breach of health & safety requirements should result in a prison sentence of up to 2 years, for the most serious offences.
So businesses must ask themselves if their management of health & safety is appropriately managed for their size and type of business.

The best way to do this is find a training organisation with trainers with the right qualifications in the subject and the fact that the trainers have themselves been trained how to train.
A good trainer will make the course relevant and interesting to their delegates by interacting with them, get them to share their experiences and job knowledge then tie these in with the course. The trainer has to be enthusiastic about what they are teaching making the course enjoyable for those involved.
This way the delegates are more likely to apply what they have learned in the workplace because the see it’s relevant and they have gained from the experience.
This in turn means the employer gets maximum value from the training they’ve provided.
At HASCAT Safety we only use trainers who are themselves trained but are committed to making the learning experience relevant, interesting and an enjoyable experience for all the delegates.
Years of voluntary work in the local community have earned HASCAT Safety a nomination as finalist in a prestigious business award competition.
Bob Chandler and his wife Sue, who launched HASCAT Safety in 2005, have supported Keech Hospice Care for many years by developing and running zero-cost training days for their staff. Now this work has been officially recognised, with HASCAT Safety being a finalist in the Community Business of the Year category in the 2015 Business Awards organised by the Bedfordshire branch of the Federation of Small Businesses (FSB).
“A lot of big businesses talk about corporate responsibility but we believe small business should also play their part,” explains Bob. “Keech does such incredible work and is extremely satisfying to know that in some small way we are helping others with the difficulties they face.”
HASCAT has recently started to support two other charities, Rennie Grove Hospice and Florence Nightingale Hospice, by supplying training ‘at cost’.
But its community work does not end there; Bob is the chairman of LB Connect, Leighton Buzzard’s premier business networking group, which donates thousands of pounds to local charities every year.
Keech Hospice Care
We are very pleased to be a finalist in the FSB Bedfordshire Business Awards 2015.
The finals are being held at Center Parcs, Woburn on 25th June. We have been selected as a finalist in the Community Business of the Year category for the voluntary work we do with Keech Hospice Care.
We donate our time to them each year to provide their health and safety induction training and health and safety refresher training.
Keech Hospice Care provides emotional and practical support for adults and children diagnosed with a life-limiting condition. Their aim is to help patients enjoy the highest quality of life, while also providing vital support for their family and friends.
